Returns/replacements
1. General points
• Products seller is UAB Merkys, registered address: Pramones st. 2, LT-65206 Varena, company code: 184536955, Vat reg. number: LT845369515, Tel. (8 310) 31 647, Email: info@merkys.com, data is stored and protected in „Juridiniu asmenu registras“.
• This document determines return and replacement conditions, as well as procedure for products purchased with the remote contract.
2. Money back guarantee
Buyer can return a non-faulty product within 14 calendar days from the day the product was delivered and get back the full amount paid for it (money back guarantee).According to legislation, certain quality goods, including bedding items, cannot be exchanged or returned. To ensure the hygiene of bedding products, they are not eligible for return.
Buyer can use the money back guarantee if the products were unused, undamaged, in the original, undamaged packaging, if the products maintained their marketable appearance and properties, and if the Buyer has proof that the products were purchased from the Seller.
3. Rules for returning faulty products
When a Buyer purchases a faulty product, the Buyer can use rights described in the Civil Code of the Republic of Lithuania and the Retail Trade Rules (No. 697; 2001-06-11). If Buyer wishes to get his/her money back and the claim is approved by the Seller, the Buyer gets his/her money back.
The return process for faulty products is free of charge for a Buyer (in Lithuania‘s territory). The product must be appropriately packaged, packaging expenses are not compensated.
The legislational warranty period for the products is 24 months (Civil Code of the Republic of Lithuania 6.364 art.)
During the warranty period, faulty products are replaced with non-faulty products, or a refund is made.
After using the product‘s warranty, the warranty period does not reset. The warranty period starts from the day when the products are delivered. The period during which the Buyer is unable to use the product because of its flaws is not added to the warranty period.
Product replacement is delivered within 30 (thirty) calendar days from the day of taking the Buyer‘s order if the Buyer and the Seller haven‘t agreed otherwise.
4. Rules and process of withdrawing from the purchase contract
Buyer has the right to withdraw from the remote purchase contract („Purchase Contract“) without giving a reason and without experiencing expenses, other than the expenses noted in the Civil Code of the Republic of Lithuania 6.22811 art. Buyer can withdraw from the purchase contract within 14 (fourteen) days from the day when the Buyer or a person chosen by the Buyer, except for a courier, receives the product. To withdraw from the purchase contract, the Buyer has to inform the Seller about it (not in an ambiguous way) using the address, email address: marketingas@merkys.com, or a phone number: +370 310 31 654 provided in the Seller‘s contacts.
If Buyer withdraws from the purchase contract, the Seller immediately, and no later than 14 days from the day the Buyer informs the Seller about the decision to withdraw from the purchase contract, refund the Buyer the amount received from the Buyer, excluding the delivery fees. The money is returned using the same method the Buyer used to pay for the products. The seller can extend the deadline for returning the money if the Buyer fails to return the products in 14 (fourteen) days. Returned products must meet the requirements set in section 9.6 of these Terms.
5. Conditions and procedure for refunds and replacements:
Before returning the products, the Buyer must get in touch using the phone number: (+370 310 31 654) or email address: marketingas@merkys.com.
When returning a product, the Buyer agrees that the returned product will be evaluated one more time in the Seller‘s location according to the requirements in the rules of the non-faulty products return process. If the product does not meet the requirements of these rules, the product is sent back to the Buyer. The Seller has to get in touch with the Buyer in 9 working days using the contact information given by the Buyer to discuss the return of the product to the Buyer.
If a product does not meet the requirements specified in these rules and the Buyer refuses to accept the product back, or the product cannot be delivered for reasons unrelated to the Seller, the Seller stores the product for no longer than 30 (thirty) calendar days from the day the last contact was made between the Seller and the Buyer to discuss how to return the product, after 30 days the product is destroyed. For products returned not according to these Rules, delivery fees are paid by the Buyer.
6. Rules for returning quality goods products while the period to withdraw from the purchase order has not ended
Returned products must be in original packaging that is in a good condition (money back guarantee, withdrawal from the purchase contract);
Returned product must be undamaged by the Buyer;
Returned product must be unused by the Buyer;
Returned product‘s marketable appearance must be maintained;
Returned products must have retained the qualities necessary for using them.
Returned product must include everything it came with to the Buyer (including gifts and other add ons) and be in an undamaged package that is in a good condition.
When returning a product, the Buyer must provide the Seller with a purchase document, as well as a filled product return document, which is delivered to the Buyer via email. In the product return document Buyer writes in his/her personal information (name, surname, email address, phone number, address, bank account number), order information (invoice number, date of delivery, code of the product that is being returned), the reason for returning the product.
All complaints can be sent to UAB Merkys email address: marketingas@merkys.com or by writing in paper to UAB Merkys, Pramones st. 2, LT-65206 Varena. The Seller has the right to evaluate complaints for 30 (thirty) days from the day the complaint was received unless the legislation of the Republic of Lithuania gives different timeframes. If the situation is complicated, the term can be extended by additional 15 (fifteen) days. The results of complaints are sent to the email or address provided by the Buyer.
